Terms of Service

These terms apply to the use of Trackbits: the web application at web.trackbits.app and the Trackbits mobile app for drivers. Trackbits is provided by Fewbits ("we", "us"). If your company has signed an agreement with us, that agreement takes precedence over these terms where they differ.
1. Who these terms are for
Trackbits is a tool for businesses. Our customer is the company that subscribes to Trackbits. Users are the people the customer gives access to, such as administrators, route planners and drivers. By using Trackbits, the customer and its users agree to these terms.
2. Accounts
- Accounts are created by the customer's administrators. The customer decides who has access and with which role, and removes access when it is no longer needed.
- Users must keep their sign-in details secret and must not share accounts.
- The customer is responsible for everything done through its users' accounts, and must tell us promptly at hey@trackbits.app if it suspects unauthorised access.
3. Content you put into Trackbits
"Customer content" is everything the customer and its users put into Trackbits, including jobs, client details, notes, and photos taken with the mobile app.
- The customer owns its customer content. We use it only to provide Trackbits to the customer.
- The customer is solely responsible for its customer content: that it is accurate, that it is lawful, that the customer has the rights and a lawful basis to collect and store it, and that it does not infringe anyone's rights. This includes content uploaded by drivers and other users.
- We do not review or monitor customer content. We are not responsible for it or for decisions made based on it.
- If we are told that customer content is unlawful or breaks these terms, we may remove it or restrict access to it, and we will tell the customer.
4. Acceptable use
The customer and its users must not:
- use Trackbits for anything unlawful, or upload content that is unlawful, offensive, or infringes someone else's rights;
- upload personal data without a lawful basis, or photos of people who have not been informed as required by law;
- try to access other customers' data, get around security or access controls, or test Trackbits for vulnerabilities without our written permission;
- overload or disrupt the service, or access it with automated tools other than those we provide;
- copy, resell or reverse engineer Trackbits.
5. Personal data
We handle personal data in customer content on the customer's behalf and according to its instructions, as described in our Privacy Policy. The customer remains the controller of that data.
6. Availability and changes
- We work to keep Trackbits available and reliable, but we do not guarantee that it will be uninterrupted or error-free. We may carry out maintenance, which we try to schedule outside working hours.
- We improve Trackbits over time and may change or remove features. We will give reasonable notice of changes that significantly reduce what the customer relies on.
- Drivers need a compatible phone and a mobile data connection. We are not responsible for problems caused by devices, networks or third-party services outside our control.
7. Fees
Fees, billing and payment terms are set out in the customer's order or agreement with us.
8. Our intellectual property
Trackbits, including its software, design and brand, belongs to us. The customer receives the right to use Trackbits for its own business for as long as its subscription is active. No other rights are transferred.
9. Suspension and termination
- We may suspend access, for the whole customer or for a single user, if it is needed to protect Trackbits or other customers, or if these terms are seriously breached. Where possible we warn the customer first.
- The customer can stop using Trackbits as set out in its agreement with us. When the subscription ends, access ends, and customer content is handled as described in the Privacy Policy. The customer can ask us to export its data before then.
10. Liability
- Trackbits is provided "as is". To the extent the law allows, we give no warranties beyond those set out in these terms or in the customer's agreement with us.
- We are not liable for indirect or consequential losses, such as lost profits, lost business or damaged reputation, or for losses caused by customer content, by users' actions, or by events outside our reasonable control.
- Our total liability to a customer for any claims in a year is limited to the fees the customer paid us for Trackbits in the 12 months before the claim.
- Nothing in these terms limits liability that cannot be limited by law, such as for fraud or gross negligence.
11. Changes to these terms
We may update these terms. We will publish the new version on this page and change the date at the top. For significant changes we will inform customers' administrators by email before they take effect. Continuing to use Trackbits after that means accepting the new terms.
12. Governing law
These terms are governed by Greek law. Disputes will be settled by the competent courts of Greece, unless the customer's agreement with us says otherwise.
